David Carlson is living a homeowner’s worst nightmare, having lawfully apprehended a fugitive on his property but then being compelled to defend himself.
David Carlson is accused of murder in the Second Degree, and related charges.
David Carlson made bail with the assistance of a neighbor who pledged her house in appreciation of all the help David had provided her over the years and his resolute defense of their community. Without her help, David Carlson likely would still be in Orange County Jail.
At the bail hearing, during which the prosecutor requested a $500,000.00 Bond, the prosecutor revealed that, based upon their examination of ballistics and pathology, that Carlson has discharged two rounds at Acosta-Sanchez, one that wounded him in the arm and the last that killed him.
As reported, ballistics and pathology are so far consistent with self-defense by David Carlson, David must nonetheless retain his own experts to review the evidence.
The District Attorney’s Press Release described the Indictment as follows:
“An indictment has been filed in Orange County Court in connection with a fatal shooting which occurred on October 11th in the Town of Deerpark. The Grand Jury found legally sufficient evidence to charge DAVID CARLSON, of 99 Old Plank Road, with the following five (5) crimes:
- Murder in the 2nd Degree in that with the intent to cause the death of another person he did so; (Maximum sentence 25 years-to-Life)
- Manslaughter in the 1st Degree in that with the intent to cause serious physical injury he caused death; (Max: 25 years)
- Manslaughter in the 2nd Degree in that he recklessly caused the death; (Max 15 years)
- Criminally Negligent Homicide,in that he caused death by reason of criminal negligence; (Max 4 years)
- Criminal Possession of a Weapon in the 4th Degree. (Max 1 year)”
The Orange County D.A. conceded in his press release that:
“The indictment alleges four different legal theories, reflecting different “culpable mental states” in the shooting death of NORRIS ACOSTA SANCHEZ. It is alleged that Carlson caused the death of Norris Acosta Sanchez by shooting him twice with a shotgun. I cannot comment on the testimony heard by the Grand Jury, which, by law, is secret and will not make any comments until the defendant is arraigned.”
